Johnson & Johnson recalls more metal hip implants

(Reuters) - Johnson & Johnson, the subject of thousands of lawsuits stemming from the 2010 recall of its ASR all-metal hip implants, last month recalled a second type of metal hip component that it sold outside of the United States.

J&J's DePuy unit told doctors in January that the Adept modular heads, a component used with its Adept metal-on-metal hip replacement device, should not be used after data showed that the devices were failing at a higher than expected rate, according to an emailed statement.

The email said British data showed that the Adept implants needed to be replaced in about 12 percent of patients after seven years. An Australian patient registry showed a revision rate of seven percent after three years.

The company said it sold around 7,500 of the hip components between 2004 to September 2011. They were sold in 21 countries, but not in the United States.

In August 2010, J&J recalled two types of its ASR metal-on-metal hip implants after they were also linked to high failure rates.

Some 93,000 of the ASR hips were sold prior to the recall, which has generated more than 10,000 lawsuits. The first suit, brought by a retired Montana prison guard who says the hip caused metal poisoning, is currently being heard in a Los Angeles Superior Court.

J&J has set aside more than $3 billion to cover costs for the ASR hip recall. The company over the past couple of years has also had to recall over-the-counter drugs, contact lenses, heart devices, such as stents, and insulin pump cartridges.

Utah couple ends legal fight over child's adoption - Salt Lake Tribune

(Al Hartmann | Tribune file photo) Terry Achane and his nearly 2-year-old daughter, Teleah, on Jan. 25, 2013. Achane was united with his daughter, who placed for adoption at birth without his knowledge or consent. A 4th District Court judge made it official during a hearing in Provo.

A Utah couple are ending their fight to overturn a judge?s ruling that sent a toddler placed at birth for adoption back to her father.

On Monday, Jared and Kristi Frei asked the Utah Supreme Court to voluntarily dismiss their appeal, saying the continued legal battle wasn?t worth the potential psychological damage the 2-year-old girl might experience if her custody continued to shift.

?

Frei family statement

?After considerable thought and reflection under heart-wrenching circumstances, the Freis have decided not to pursue their appeal of this contested adoption. Although the Freis remain convinced that the district court committed significant legal errors in this case, they believe that it would be best for the child to drop their appeal now that she has been transferred into the custody of Mr. Achane. The Freis are committed to working with Mr. Achane to assist the child in making a successful transition. Because the Freis love the child deeply and want her to succeed in life, they are willing to put her needs before their own hopes and desires and would rather drop the appeal than risk the child suffering potential psychological and emotional consequences resulting from her either not making a successful transition or transitioning to caregivers multiple times in this critical stage of her development.?

Terry Achane, currently stationed at Fort Jackson in South Carolina, received custody of his daughter Teleah on Jan. 25. The court was to hear the Freis? appeal in March.

The dismissal motion, filed by the Freis? attorney Lance Rich, states that the couple believes 4th District Judge Darold McDade made "serious errors" in giving Achane custody of his daughter, who was placed for adoption without her father?s knowledge or consent.

But the only way they could "ultimately prevail" would be if it were beyond dispute that Teleah did not successfully transition to her father.

Rich issued a statement on behalf of the Freis on Monday that said they had decided not to pursue the appeal of the contested adoption "after considerable thought and reflection under heart-wrenching circumstances."

"The Freis are committed to working with Mr. Achane to assist the child in making a successful transition," the statement said. "Because the Freis love the child deeply and want her to succeed in life, they are willing to put her needs before their own hopes and desires and would rather drop the appeal than risk the child suffering potential psychological and emotional consequences resulting from her either not making a successful transition or transitioning to caregivers multiple times in this critical stage of her development."

Achane, 31, and his then-wife Tira Bland were living in Texas when she conceived Teleah, who was due in mid-March 2011. Achane, an Army drill sergeant, received a job transfer to South Carolina that winter and left Texas in mid-January to set up a home. Ten days later, Bland decided to place their baby for adoption and traveled to Utah to give birth. She claimed her husband had abandoned her and had no interest in their child.

The Adoption Center of Choice placed the baby, born on March 1, 2011, with the Freis. Achane was initially unable to reach his wife and did not learn what had happened until June 2011. He immediately contacted the agency and demanded the return of his daughter, which was refused. In November, McDade ruled Achane?s parental rights had been violated, dismissed the adoption and ordered the child?s return to her father. At that point, the Freis appealed.

"We are extremely pleased that the Freis? have decided to drop their appeal to the Utah Supreme Court and to allow Teleah and her father an opportunity to move on with their lives together as they should have been allowed to do almost two years ago," said attorney Mark Wiser, who with his son Scott represented Terry Achane. "Legally speaking, it is probably a smart decision on their part to not allow the Supreme Court to rule on this case as it would have provided a very bad legal precedent that might have forced the Utah adoption industry to clean up their act of going behind fathers? backs to terminate their parental rights. This case was so important because it placed the focus on allowing parents to care for their children and not having others deny them their fundamental right to parent."

Obama commends Apple Intel for U.S. manufacturing jobs

CNet Wednesday 13th February, 2013

State of the Union speech tonight was that U.S. companies need to create jobs here. Not only did he stress this need, he also praised those companies already in the process of doing this, including Intel and Apple. "Our first priority is making America a magnet for new jobs and manufacturing. After shedding jobs for more than 10 years, our manufacturers have added about 500,000 jobs over the past three," Obama said in his speech. "Caterpillar is bringing jobs back from Japan. Ford is bringing jobs back from Mexico. After locating plants in other countries like China, Intel is opening its most ...

Homes wrecked, dozen hurt in Mississippi tornado

HATTIESBURG, Miss.?A tornado tore through Hattiesburg on Sunday as part of a wave of severe storms that downed trees, damaged buildings and injured more than a dozen people.

The twister traveled down one of Hattiesburg's main streets and mangled homes, commercial buildings and structures on the campus of the University of Southern Mississippi. Emergency officials said at least 10 people were injured in surrounding Forrest County and three were hurt to the west in Marion County, but they weren't aware of any deaths.

Mississippi Emergency Management Agency spokesman Greg Flynn said it appears that a single tornado caused the damage in those two counties and Lamar County. Hundreds of homes are damaged in Forrest County, along with a couple dozen in the other two. Gov. Phil Bryant declared a state of emergency.

Flynn said the sheer scope of the damage was slowing their assessment.

"The problem is, it was so strong that there's so much debris that there's a lot of areas they haven't been able to get to yet," he said.

On the campus of the university, trees were snapped in half around the heavily damaged Alumni House where part of the roof was ripped away. Windows in a nearby building were blown out, and heavy equipment worked to clear streets nearby in a heavy rain after the worst of the weather had passed.

The university released a statement saying no one was hurt but that it was under a state of emergency, anyone away from campus should stay away until further notice.

East of campus, 47-year-old Cindy Bullock was at home with her husband and dog, a terrier mix named Vinnie, when she heard the tornado coming. They ran to a hallway and covered their heads. It wasn't long before the windows in the kitchen and bedroom exploded. The storm stripped all the shingles off the roof and left holes in it, while knocking over a large pine tree in the yard.

After dark, the Bullocks were trying to arrange their stuff inside so it wouldn't get wet from the dripping water.

"I just looked out the window and I heard the rumbling. It sounded like a train. We ran to the hall, and the kitchen windows and the windows in the bedroom exploded. It happened pretty fast," she said.

There were large trees blocking the road all through her neighborhood, and several of the houses were hit by falling trees. Her friend was staying with them after the friend's apartment took a direct hit from a falling tree.

Forrest County Sheriff Billy McGee says 10 or 15 people were injured by the tornado that slammed Hattiesburg and other parts of the county?but none of the injuries was serious.

He says, "Most of our injuries have been walking wounded."

To the west, Marion County emergency director Aaron Greer says three injuries have been reported in the community of Pickwick, about seven miles south of Columbia. He says two people were taken to hospitals, but the third didn't have the injury examined.

Greer says one mobile home was destroyed, three other structures have major damage and several have minor damage.

Bryant plans to go to Hattiesburg on Monday to check out damage in the city and at USM, his alma mater, spokesman Mick Bullock said.

On Sunday night, John and Katherine Adams were cleaning up around their one-story white house where the storm punched holes in the roof, busted windows and completely destroyed the back porch. The couple was at home with their 7- and 3-year-old daughters when the tornado passed next to their house.

All through the neighborhood, houses and vehicles were damaged by falling trees.

"We're safe, and that's all that matters," said Katherine Adams, 46.

John Adams, who's in the building supply business, said he was surprised to see broken boards that appeared to be from new construction in his yard because there are no homes being built nearby.

"We've got stuff around here; I don't even know where it came from," he said.

When In Necessity For Acupuncture Miami Needs The Priority ...

When in need of safe acupuncture Miami presents the best place for one to check out. Acupuncture is a form of alternative medicine methodology that originated from the old China. The details of the precise time when this practice started being exercised in the ancient China are still unknown. There is very little written history about the ancient form of this practice. The exercise expanded to other continents mostly during the second world war.

The general theory of this method bases on the belief that body functions are regulated by an energy referred to as qi, also called chi. This energy flows through the entire body and is maintained in some form of balance. Diseases are believed to be caused when this energy is disrupted. Acupunctural practice illustrates detailed procedures aimed at restoring the balance during diseases in the body.

The chi energy streams along defined pathways in the body known as acupoints or acupuncture points. This method heals patients by manipulating slim, solid spines that are placed into the human body at acupoints. The acupoints are located with care by the expert by inspecting the skin surfaces or through other techniques. Once they are identified, the slim needles are inserted into the skin.

This practice is also exercised in the modern times without making references to scientific methods. A visit to an acupuncturist starts by the practitioner inspecting the tongue and taking pulses on both hands. The clinic version is greatly individualized and basing on intuition and philosophy. An average session takes something between ten minutes to one hour. Diagnosis and treatment services received cost between 25 to 80 dollars.

Acupunctural practice varies a lot from one country to another with Chinese clinics receiving up to 10 patients in every hour. In Miami city, the average number of people seeking for these services is at 1.2 individuals per hour. The region also has much effect on how the whole practice is performed. In some regions, the needles remain for up to 3 days in the ear.

Acupuncture may be applied in treatment of many conditions and illnesses. Some of the key conditions and diseases for which most individuals seek this service are pains, stroke rehabilitation, and neurological problems. The needles utilized are constructed of stainless steel and are normally disposable though reusable ones could be used too. Reusable needles should be sterilized before being reused.

Needles vary in length and shorter ones are used near the eyes and face. The size of needle used on a person is determined by the body weight, strength, and fleshiness. There may be a little pain when they are inserted for the first time. More skilled practitioners can insert the needles without causing any pain at all. One may need several sessions to be healed fully. The decision of the number of sessions lies with the professional themselves.

When in need of the most perfect acupuncture Miami is the right place to check out. There are several practitioners within the area who offer very affordable rates to all clients. One can check them out and place an appointment with them in advance.
